Säkerhetsförvaring innebär att domstolen först bestämmer en minimitid som ska avtjänas i fängelse och som motsvarar det fängelsestraff som annars skulle ha dömts ut. Förutom detta ska en ramtid bestämmas på ytterligare fyra till sex år. Ramtiden får förlängas med högst tre år åt gången om det är absolut nödvändigt för att avhålla den dömde från att återfalla i allvarlig brottslighet. Vid minimitidens utgång kan domstolen besluta om så kallad villkorad utslussning. Det innebär att Kriminalvården får besluta att den dömde ska avtjäna påföljden utanför anstalten med särskilt stöd och under kontroll. Om personen missköter sig eller begår nya brott kan utslussningen avbrytas. Syftet med regeringens förslag är att stärka samhällets skydd mot personer som har begått allvarliga brott mot andra personer och som även har en hög risk för återfall i sådan brottslighet, men som inte är aktuella för rättspsykiatrisk vård eller livstids fängelse. De nya reglerna föreslås börja gälla den 15 april 2026.
